4rentus.com Terms and Conditions
This agreement applies to all services furnished by 4rentus.com, a division of All Apts, (the "Internet Provider"), to you (the "client"). This website is offered to the client conditioned upon your acceptance of this Membership Agreement without modification, and your use of this website constitutes your agreement to, and acceptance of the Membership Agreement.
This agreement becomes active upon receipt of payment in full and will automatically renew at the end of the agreed term unless notified 30 days prior to the start of your next payment period.
1. Acceptance : Acceptance of all content by 4rentus.com is subject to review and approval by the management in its' sole discretion.
2. Copy and Material : 4rentus.com reserves the right to revise or reject for any reason at its sole discretion any advertising copy submitted. All advertising materials created by 4rentus.com remain the property of 4rentus.com and may not be reproduced in any other publication, websites or materials without the written consent of 4rentus.com. It is also agreed that 4rentus.com can utilize any available pictures, floor plans, brochures and any other pertinent materials to be included for the sole purpose of promotion of your property.
3. Errors : 4rentus.coms' liability for damages resulting from errors in any advertising that it publishes or from its failure to publish any advertisement that it has agreed to publish shall be limited to the amount it actually received in consideration for its agreement to publish the advertisement in question. 4rentus.com shall not be responsible for any special, incidental, or consequential damages suffered by any party resulting from its errors or omissions.
4. Hold Harmless : The client accepts all liability for the content of all advertising supplied by the client. The client warrants to 4rentus.com that its copy is true, that it is not libelous or defamatory, that it violates no rights of privacy, that it infringes no trademark, copyright, literary or other rights, nor constitutes unfair competition with any other party, and that it complies with all federal, state and local laws and regulations. The fact that the copy that has been submitted to 4rentus.com for approval and has been previously approved by 4rentus.com, either in whole or in part shall not relieve the client of this warranty. The client agrees to defend, indemnify and hold harmless 4rentus.com any and all claims, demands, liability, suits, costs or expenses, arising by reason of the publication of the client's submission or breach of the foregoing warranty, whether such claims are well grounded or not.
5. Inability to Perform : Neither party shall be required to perform any term or condition so long as such performance is delayed or prevented by computer, telecommunications, or other system outages, or forces of nature, which shall mean acts of god, strikes, lockouts, material or labor restrictions by any government authority, civil riots, floods, power outages, and any other cause not reasonably within the control of the performing party and which, by due diligence, such party is unable, wholly or in part to prevent and overcome.
6. Payment : Client agrees to pay all amounts due to 4rentus.com upon the date of receipt of invoice. If payment is not received within thirty (30) days after receipt of invoice for any charges due client, 4rentus.com, at its' discretion, may cancel client's future advertising, and charges for all prior advertising used by the client will become immediately due and payable, in addition to other charges or legal costs provided herein.
7. Service Charge : A service charge of 1.5 % per month (18%/year) or the maximum rate allowed by law, will be applied to all past due balances. (We appreciate prompt payment to be able to continue our steady marketing, this will help us avoid any such charges and enables us to rarely have to enforce them.)
8. Attorney and Collection Fees : If for any reason payment is not made in full when due, the client agrees to pay any and all Attorney and Collection fees and any Court cost incurred by 4rentus.com.
Acceptance of this agreement allows 4rentus.com to communicate with the client via fax, telephone, email and U.S. mail for any reason during the term of this agreement and following the termination of this agreement
